Public Intoxication and Underage Possession of Alcohol Charges Dismissed

Individual who was attending school charged with public intoxication and underage possession of alcohol in Prince William County.  Prosecutor agreed to have the judge dismiss the charges if certain conditions were fulfilled.  Individual completed conditions and charges were dismissed.  Both charges were eligible for expungement.  

Possession of Marijuana Nolle Prossed & Firearm Charge Amended

Individual charged with possession of marijuana and brandishing a firearm in Fairfax County.  Individual also had other issues that made a firearm conviction very problematic.  Firearm charge was amended to trespassing and the possession of marijuana charge was nolle prossed.  Individual served no active jail time and only had one year of probation.

False ID to Police Officer & Petit Larceny Nolle Prossed

Individual was charged with falsely identifying himself to a police officer investigating an alleged robbery in Fairfax County.  After pointing out issues with prosecutor’s evidence, the case was ultimately nolle prossed.  Both charges were eligible for expungement.

DWI/DUI Charge Dismissed After Trial

Individual charged with driving while intoxicated, refusal, and driving on a revoked license in Fairfax County.  Individual was also on felony probation at the time of these charges, and the prosecutor would not resolve the case in a way that would not violate individual’s probation.  Case proceeded to trial, and the judge found the individual not guilty of DWI, but did convict on the other two charges.  However, individual was able to avoid probation violation as a result and no jail time was imposed for the convictions.  

Possession of Marijuana Charge Nolle Prossed

Individual employed by government charged with possession of marijuana in Arlington County.  Prosecutor would not offer a resolution, so case proceeded to trial.  Judge granted the motion to suppress the search of individual, which led to discovery of marijuana.  Prosecutor then nolle prossed the charge.  Individual was eligible to expunge the charge.

Domestic Assault and battery Charge Nolle Prossed

Individual with law enforcement background accused of battering spouse in the City of Alexandria.  Individual faced likely loss of employment if convicted.  Additionally, spouse sought protective order.  Both cases were dismissed by the judge, and individual was eligible to expunge criminal charge.

Possession of Synthetic Marijuana Reduced to Drunk in Public

Individual charged with possession of synthetic marijuana in Fairfax County.  Police only discovered the substance because individual was assisting a person in need.  Prosecutor agreed to reduce charge to drunk in public, a class 4 misdemeanor that carried no jail time and a $50 fine.

Underage Possession of Alcohol Nolle Prossed

Individual charged with underage possession of alcohol in Fairfax County.  Individual was initially convicted because of his failure to appear.  After retaining counsel, the case was reopened and nolle prossed despite individual being charged with new offenses during the case.  Individual eligible to expunge charge.

Public Intoxication & Contributing to Delinquency of Minor Charges Nolle Prossed

Individual was charged in Fairfax County with contributing to the delinquency of a minor and public intoxication.  The charges posed complications with future employment and educational goals.  Individuals’ charges were all dropped by agreement with the prosecution.  Individual was eligible to remove all records of charges from background databases.

Reckless Driving Charge Reduced

Individual was charged with Reckless Driving (79 mph) in Fairfax County, faced a potential class 1 misdemeanor conviction, and 6 demerit points assessed against driver’s license.  Individual received reduction of charge to traffic infraction of Speeding, reduction in total speed, and reduction in demerit point assessment.

Individual charged with assault and battery of a nightclub bouncer and public intoxication in Arlington County.  Both charges were nolle prossed after discussions with the prosecutor.  Individual was eligible for expungement of both charges.

Harassing Phone Calls, Preliminary Protective Order Violation, and Permanent Protective Order Request Dismissed

Individual accused of making harassing phone calls to child’s parent who lived in Fairfax County.  Child’s parent also claimed that individual also made contact with her after a preliminary protective order was served on him.  Prosecutor nolle prossed the phone call and probation violation charges after subpoenaed video footage exposed the child’s mother’s lies.  The permanent protective order was later dismissed by a judge.

Individual charged with simple possession of marijuana had charge nolle prossed due to legal issues with case and out-of-court steps taken by individual.  Individual was eligible for expungement of charge, as well.

Individual charged with assault and battery of employee at facility.  Prosecutor refused to make a reasonable offer under the circumstances and suggested that jail time was an appropriate outcome.  Case proceeded to trial, and the judge found the individual not guilty of the offense.  Individual was eligible to expunge the charge.

Individual charged with domestic assault and battery of child in Fairfax County.  Prosecutor agreed to nolle pros the case after all of the details of the encounter were provided.  Individual was eligible for expungement of charge.

Reckless Handling of Firearm Charge Dismissed

Individual charged with reckless handling of a firearm in Prince William County.  Victim alleged that individual pointed firearm at victim while in verbal altercation.  Prosecutor initially would not dismiss the charge, but ultimately agreed to a resolution where the charge would be dropped and the individual charged would be eligible for expungement.

Possession of Marijuana Dismissed

Individual was charged with simple possession of marijuana in Fairfax County.  The charge was dismissed after individual’s conviction was deferred for one year.  No jail time or fines were imposed.  

Felony Embezzlement Reduced to Misdemeanor Embezzlement

Individual accused of embezzling over $20,000.00 from employer in Fairfax County.  After auditing account and discussing results with the prosecutor, charge was reduced to misdemeanor embezzlement.  Additionally, no active jail time was imposed, and individual placed on only one year of probation.

Individual charged with assault and battery in Fairfax County.  Charge was dismissed without trial due to client’s self-defense claim.  As a result, the individual was eligible to remove the records of the charge.

Possession of Marijuana and Speeding Charges Both Amended

Individual charged with possession of marijuana and speeding in Fauquier County and facing potential loss of license due to drug conviction and four demerit points on DMV license due to speeding offense.  After negotiations, the prosecution agreed to amend the drug charge to a possession of paraphernalia offense, which avoided suspension of the individual’s driver’s license, and the speed of the speeding offense, which lowered the demerit point assessment.

Individual charged with battering spouse in Fairfax County.  After discussions with the prosecution and in light of steps undertaken by client prior to trial, the prosecution agreed to nolle pros the charge.  Individual was eligible to expunge all records as a result.

Protective Order Denied & Domestic Assault and Battery Charge Nolle Prossed

Individual was charged with domestic assault and battery and was facing entry of a potential 2-year protective order in Prince William County.  The prosecution nolle prossed the charge once video evidence was provided by the defense to the prosecution that the “victim” had falsified the allegations regarding what happened and the extent of her injuries.  A judge also dismissed the same “victim’s” protective order request after seeing video evidence of “victim” acting inconsistently with her alleged injuries.

Individual charged with battering spouse in Fairfax County.  Charge was dismissed without a trial after discussing individual’s pre-trial efforts and circumstances of parties involved in case with prosecutor.  Individual was eligible to expunge the charge.

Individual who was on supervised probation for larceny offense was brought before the court for a probation violation due to nonpayment of restitution.  The case was presented to the judge, and he not only dismissed the probation violation, but also reduced supervised probation to unsupervised probation and later completely terminated probation.

Probation Violation Dismissed

Individual was charged with a probation violation for failing to show up to treatment, making threatening calls, and bizarre behavior during meetings at the probation office.  After investigating the case, it was clear that mental health issues were seriously affecting the individual’s abilities to comply with probation.  The situation was explained to the judge with letters of support from treatment providers.  The judge agreed to dismiss the probation violation charge and no negative consequences were suffered by individual.
